Allow Municipalities to create ISPs

Why not ensure that cities will be able to create their own ISPs if the company operating in the area refuses to improve their service. I've heard of cities getting sued over this, ISPs claim cities have an unfair advantage in that they have access to lines of credit private companies normally wouldn't.
