Why not ensure that cities will be able to create their own ISPs if the company operating in the area refuses to improve their service. I've heard of cities getting sued over this, ISPs claim cities have an unfair advantage in that they have access to lines of credit private companies normally wouldn't. While that's unfair, its also unfair to deny an area access to new technologies even when they're willing to pay for it, because its cheaper to just make them pay more without really improving the service.
This may be beyond the FCC's jurisdiction, but guaranteeing that cities can't be sued for starting their own ISP might scare local monopolies into providing adequate service, since they will know if they provide a terrible service, the local government could step in and start competing.
